These Terms of Service ("Terms") govern your use of the Symkind platform, website (symkind.ai), WordPress plugin, widget, and associated services (collectively, the "Service"). The Service is operated by Garcia Multimedia LLC ("Symkind," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Symkind provides AI conversational agents for businesses. Our agents are powered by structured business genomes — text artifacts of 50,000 words or more describing a specific business — combined with large-language-model technology to produce conversational responses that represent the business to its customers.

You must be at least 18 years old and legally able to enter into contracts to create a paid account. Business subscriptions are available to legitimate businesses and their authorized representatives. You are responsible for the accuracy of the information you provide and for maintaining the security of your account credentials.
Symkind offers free-tier access with usage limits and paid subscription tiers (Associate, Senior, Partner, Super Agent, Elite) billed monthly. Current pricing is published at symkind.ai/pricing.html. Fees are charged in advance each billing period. Subscriptions renew automatically unless cancelled before the next billing date. Refunds are issued at Symkind's discretion in response to genuine service failures; normal usage fees are not refundable.
Free-tier usage is rate-limited and provided as-is. Free-tier visitors see "Powered by Symkind" branding in the chat widget.
You may not use the Service to:
You retain ownership of any content you provide to Symkind for building your business genome — your company information, your voice, your product details, and similar. You grant Symkind a worldwide, non-exclusive license to use that content solely to operate the Service on your behalf. We will not sell your business content to third parties or use it to train public models.
You represent that you have the right to provide us with any content you supply, and that doing so does not violate the rights of any third party.
Your customers interact with the agent through the chat widget on your site. Their messages are transmitted to Symkind's servers for processing and response generation. At the Associate tier, conversations are processed in real time and are not retained beyond the immediate session. At Senior tier and above, compressed memory records are retained to enable cross-session memory of returning customers, subject to the retention and deletion terms in our Privacy Policy.
You are responsible for obtaining any end-user consents required by applicable law in your jurisdiction (including but not limited to GDPR, CCPA, and similar frameworks) regarding the processing of visitor data through the Service on your site.
The Service, including all software, documentation, trademarks, and content created by Symkind, is the property of Garcia Multimedia LLC and is protected by intellectual property laws. Patents pending and filed cover key inventions in the Service, including genome composition, voice preservation, identity-preserving multilingual rendering, tiered historical accumulation, and boardroom orchestration.
These Terms do not transfer any Symkind intellectual property to you. Your license to use the Service is limited to the scope described in these Terms.

Symkind is responsible for the overall Service; third-party services are subject to their own terms and policies.
The Service is provided "as is" without warranties of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, and non-infringement. AI agent responses are generated by automated systems and may contain errors. You should not rely on agent responses for legal, medical, financial, or other professional advice. For such advice, consult a qualified professional.
To the maximum extent permitted by law, Symkind's aggregate liability to you for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid Symkind in the twelve months preceding the claim, or (b) $100. Symkind is not liable for indirect, incidental, special, consequential, or punitive damages.
You agree to indemnify and hold Symkind harmless from any claim, loss, or damage arising out of your use of the Service, your content provided to the Service, your breach of these Terms, or your violation of any law or third-party right.
You may cancel your subscription at any time through your account or by contacting us. Symkind may suspend or terminate your access to the Service for material breach of these Terms, for non-payment, or if required by law. Upon termination, your right to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and indemnification).
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date and, where practical, communicated to paid subscribers via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arizona, United States, without regard to conflict of laws principles. Disputes arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Pima County, Arizona, except where applicable consumer law provides otherwise.
